Cancellation fund for Feather Down Farm Days.
Conditions of Feather Down Farm Days' cancellation fund.
1. DESCRIPTION OF CONCEPT IN THE CONDITIONS IS UNDERSTOOD UNDER:
1.a Tenant: the person and his/her fellow travellers stated on the confirmation. 1.b Rent: the sum stated on the rental agreement. 1.c Cancellation costs/ legally payable rent, or a part of this, and transfer costs in the case of a cancellation. 1.d Family: group members travelling together. A tenant travelling without group members is also regarded as a family.
2. COMMENCING DATE AND PERIOD OF VALIDITY.
The cover starts from the first down payment, stated on the confirmation, and finishes on the termination date of the package according to the confirmation.
3. COVER.
3.a Benefit is granted for cancellation costs as a result of an uncertain event as stated in 3a up to and including 3.a.11.
3.a.1 Death, serious illness or serious accident of tenant, family members in the 1st or 2nd degree or group members of the tenant.
3.a.2 Complications with pregnancy of tenant or cohabiting partner.
3.a.3 Material damage of property of tenant or the company where he works, as a result of which his presence is urgently needed.
3.a.4 The availability, unexpectedly of a rental house for the tenant, yet not earlier than 30 days before commencement of the package.
3.a.5 A medically necessary intervention which the tenant or cohabiting partner need to undergo unexpectedly.
3.a.6 Moving out of sheer necessity of tenant because of medical need, renovation or change in the working environment.
3.a.7 Involuntary unemployment of tenant as a result of entire or partial closure of the company where he works.
3.a.8 The acceptance of employment by an unemployed tenant of a minimum of 20 hours per week, for the duration of at least 1 year or for an indefinite period of time, which makes his presence for the fulfilment of that necessary at the time of the package.
3.a.9 Unexpected call to the tenant after the final examination for a re-examination which cannot be taken at a time other than during the stay.
3.a.10 Unexpected call to the tenant for the initial or retraining exercise in military service.
3.a.11 The failure of the private means of transport of the tenant to be used for the trip, due to an external calamity, within 30 days before the commencement of the package.
3.b. Benefit is granted for non-used sojourn days as a result of a circumstance as stated in 3b.1 up to and including 3b.3. The benefit is calculated on the basis of the rent in proportion to the number of non-used sojourn days booked up to the total number of sojourn days.
3.b.1 Unforeseen delay, longer than 8 hours, of the boat, bus, train of plane to arrive at the reserved accommodation. This cover consists only for packages of more than 3 days and the maximum benefit is 3 days. A delay of between 8 to 20 hours is counted as a 1 day. 20 to 32 hours as 2 days, and longer than 32 hours as 3 days.
3.b.2 Interruption of the stay through an uncertain event as stated in 3a.1 up to and including 3a.5.
3.b.3 Unforeseen hospitalisation (minimum 1 night) of tenant, as a result of which interruption is not possible, whereby all hospitalisation days in the rental period are considered as non-used sojourn days. This cover only applies to the hospitalised tenant and for his fellow travelling family members or 1 fellow travelling tenant.
3.c. The maximum benefit for all tenants together is at the most the benefit for 2 families, divided over all tenants in proportion to everybody's share in the rent.
3.d. Benefit is granted under deduction of possible refunds.
4. EXCLUSIONS.
4.a No benefit is granted if tenant or the interested party:
4.a.1 Provides a false and/or incorrect picture of the situation. In that case the right to benefit for the entire progress is cancelled. Also for those matters where no false and/or incorrect picture of the situation has been given.
4.a.2 Negligence refers to the fulfilment of any of the obligations resting on him under this insurance.
4.b. No benefit is granted for a claim as a result of an event.
4.b.1(In)directly linking to: molestation, among which is understood an armed conflict, civil war, insurrection, internal riots, revolt, mutiny, atomic nuclear reaction, acts of terrorism, hijack, sky-jacking, strike or any other force majeure;
4.b.2 Occurred or made possible through intention, gross culpability or with the will of tenant or interested party.
4.b.3 (In)directly related to the suicide of tenant or attempt to this end.
4.b.4 In the event of or as a result of taking part in or committing a criminal offence, or attempt to this end.
4.b.5 Concerning decease, disorder or deviation which existed or caused complaints with the tenant, his group or family members in the 1st or 2nd degree in the period of 3 months before the start date of the insurance. This exclusion is only effective if the insurance has been taken out later than 7 days after the booking date.
5. INSURED AMOUNT.
5.a The insured amount must be set on the full price of the travel /rental package.
5.a.1 No premium refund is granted other than in the case of cancellation of the travel/rental agreement through a travel/transport organisation or letter.
6. OBLIGATION IN THE CASE OF DAMAGE.
6.a Tenant or interested party is obliged:
6.a 1 To do all that is reasonably possible for the prevention, reduction or restriction of damage.
6.a.2 To immediately call in medical aid in the case of accident or illness and to not refrain from doing anything what could improve the recovery. Tenant is also obliged to have him/herself examined at the request of Feather Down farm.
6.a.3 To provide to Feather Down farm all cooperation required in reasonability and to provide data truthfully.
6.a.4 To prove the circumstances which lead to a request for benefit.
6.a.5 To submit original evidence.
6.a.6 To give cooperation in the case of recourse on third parties, possibly through transfer of claims.
Method of reporting.
6.b Tenant or interested party is obliged:
6.b.1 After an event, as a result of which a cancellation (possibly) takes place, communicating this immediately, yet at the latest within 3 working days after the event, to Feather Down farm.
6.b.2 To make available to Feather Down farm, as soon as possible yet at the latest within 1 month after the duration of validity of the insurance, an entirely completed and signed damage claim form. You must request these forms yourself at Feather Down farm.
6.c. Statements made with a report as stated in 5.b.1 and 5.b.2 also serve for the determination of the damage and the right to benefit.
7. CLAIM SETTLEMENT.
Feather Down farm is charged with the regulation (having regulated) of damage, by means of the data and information supplied by tenant.
8. RIGHTFUL CLAIMANT.
8.a The right to benefit only exists for the tenant. If a tenant has a right to benefit on the basis of this insurance the other tenants also have this right, on the proviso that these also cancel or interrupt their stay prematurely, with the exception of that stated in 3.b.3. 8.2. Benefit will take place to a tenant (unless other tenants have objected against this, before payment of the benefit, in writing to Feather Down farm).
9. TIME LIMIT OF THE RIGHT TO BENEFIT.
In the event that Feather Down farm has made known a definitive point of view in writing with regard to the claim, then every right expires towards Feather Down farm to the point of the casualty in question after the course of 6 months, which period starts on the day on which Feather Down farm has sent this report.
10. ADDRESS.
Notifications by Feather Down farm to tenant take place legally to the address last known to Feather Down farm or to the address of the person, through whose mediation the insurance has been taken out.
